Bengaluru: Karnataka high court Thursday dismissed a petition filed by a 53-year-old tailor from the city seeking to quash the Pocso case registered against him for allegedly inappropriately touching a 13-year-old girl while taking measurements for a dress.
The court rejected his alibi after an investigation revealed that his “medical treatment” on the day of the incident lasted a mere two minutes.
The accused had been arrested by Whitefield police following the incident on April 17, where he allegedly fondled the minor girl while taking her body measurements for tailoring.
Seeking to quash the first information report (FIR), the accused approached high court, claiming he was innocent and present at Sri Sathya Sai Institute of Higher Medical Sciences for diabetes treatment between April 15 and April 17, making his involvement in the crime impossible.
Taking note of the alibi, Justice M Nagaprasanna had previously directed the investigating officer from Whitefield police station to verify the claims and file a detailed affidavit outlining the accused’s medical consultations at the hospital.
When the police submitted their findings to the court Thursday, the detailed timeline debunked the tailor’s defence.
Reading directly from the police affidavit, Justice Nagaprasanna noted the exact duration of the petitioner’s hospital visits:
“Accused was consulted for three minutes on April 15; five minutes on April 16 and two minutes on April 17. They have checked his diabetes on a glucometer and sent him back,” the judge observed.
Questioning the validity of the tailor’s defence, Justice Nagaprasanna sharply remarked, “Is this treatment?” before summarily dismissing the petition, allowing the criminal proceedings against the accused to continue.
